Vacay Hill Country Rental Agreement

By submitting this reservation, you are agreeing to the following terms and conditions:

Age & Occupancy Restrictions
You must be at least 25 years old to rent a property. At any time Vacay Hill Country may request, and the guest who reserved must provide, a valid ID as proof of age. The reservation holder must be on-site for the entire duration of the reservation. Maximum occupancy at any time is equal to the number of guests a property ‘sleeps’, as listed per property. Unless approved in advance, exceeding the occupancy at any time will result in an additional $500 minimum charge to your credit card and will result in the forfeiture of your stay without refund. Vacay Hill Country has the right to inspect the number of people in your party.

Parties
No house parties or weddings allowed at properties. If there is a party in the property (as further evidenced by a noise complaint, security report, or by excessive amounts of trash or destruction) the guest will be charged for complete clean and replacement of damaged items and property.

Vehicle Limits
Please see individual property listings for the number of vehicles allowed at each rental; please contact us if you’d like to request an exception. Driving and parking on lawns and grassy areas is prohibited. Towing and ticketing may enforced, and Vacay Hill Country is not responsible for, nor will Vacay Hill Country pay for the salvage of a vehicle not parked in a designated parking area. To comply with city and county short-term rental permit restrictions, the outdoor driveways/parking areas of some homes are monitored by video camera.

Internet Availability
Most properties are WiFi enabled; this is a service paid by the owner and an added benefit to the guest at no additional cost and provided by a local service provider. Vacay Hill Country cannot guarantee reliable internet service. Circumstances outside of Vacay Hill Country’s control may result in internet service interruptions, outages, degradations, or what the guest may consider less than satisfactory service to what they may be accustomed to. Vacay Hill Country will not reimburse or refund any monies to the guest in the event of any of the above circumstances. If a guest wants to ensure optimized and reliable service, Vacay Hill Country recommends guests travel with their own air card.

Check-in & Check-out Times
Check-in time is 4pm; check-out is 10am. Unless arrangements for late check-out are confirmed, Vacay Hill Country is authorized to charge for an extra night for any guests remaining past check-out time.

Smoking & Pet Policy
No smoking or pets are allowed in any property, unless otherwise specified in the listing. Failure to comply will result in an automatic $500 minimum charge to your credit card for additional cleaning.

Property Cleaning & Damage Disclosure
Vacay Hill Country reserves the right to charge your credit card in order to recoup the cost of repairs or replacement due to any damage done to property or its contents. Cleaning after your departure is provided but properties left in poor condition, including unwashed dishes in the kitchen, will be subject to an additional fee.

Items Left at Property
$25 plus the cost of packing and shipping will be charged to retrieve and return any personal items left at the property. Vacay Hill Country is not liable for any items or the cost to replace them, in the case that they are not able to be found. Items not claimed within 10 days of departure will be disposed of or donated.

SMS COMMUNICATION
By making a reservation with Vacay or contacting Vacay you have opted in to SMS/MMS texts. Vacay sends texts and picture messages to you regarding your reservation. If you would like to opt-out of these communications reply STOP. Replying STOP will prevent you from receiving any SMS or MMS communications from Vacay. You can resubscribe at any time by texting UNSTOP.

Waiver of Liability
By proceeding with this reservation and checking into the property, the reservation holder, representing members of his/her party and guests (hereinafter referred to individually and/or collectively as ‘GUESTS’) who desire to rent the referenced property (hereinafter referred to as ‘PROPERTY’ or ‘the PROPERTY’), for short-term vacation purposes, hereby agrees to release and waive all liability in consideration for being permitted to enter PROPERTY. Each person who arrives on the PROPERTY does so at their own risk and accepts full liability and responsibility for that risk and whatever occurs to them while they are on or around the PROPERTY. GUESTS acknowledges and accepts these risks and RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT SUE Vacay Hill Country Vacation Rentals or the OWNER of the PROPERTY, either personally and/or as a company or corporate representatives, including their members, managers, operators, officials, officers, directors, employees, owners and/or lessees of the PROPERTY, (herein referred to as ‘RELEASEES’).
In consideration for being permitted to enter the PROPERTY for vacation or any other purpose, GUEST agrees and represents that he/she will immediately upon entering, and continuously thereafter, thoroughly inspect the PROPERTY for any unsafe conditions, and if any part of PROPERTY is deemed to be unsafe at any time, GUESTS will immediately leave the area and advise the appropriate person(s).
WARNINGS: Use of decks, pools, hot tubs, bunk beds, fireplaces, and outdoor grills carry risks that may result in serious injury or death. Local terrain features on the PROPERTY including, but not limited to, hills, ledges, paths, and water access pose inherent risks to users. Swim at your own risk. No children under the age of 12 are permitted to use a hot tub at any time and no children under the age of 12 are permitted on a deck without adult supervision. The American College of Obstetricians and Gynecologist (ACOG) states that becoming overheated in a hot tub is not recommended during pregnancy. Elderly persons and anyone subject to heart disease, diabetes, low or high blood pressure, strokes, epilepsy or similar afflictions should not enter a hot tub without consulting their physician. Never use a spa while under the influence of drugs or alcohol or if you are taking medications of any kind, or being treated for any illness. A spa should be kept at a temperature less than 104 degrees for personal safety and all bathers must shower before and after use to decrease the possibility of skin problems. Do not sit or walk on a spa cover, or it will collapse. Supervise children at all times to decrease risk on injury, death or drowning.
GUEST hereby acknowledges that the PROPERTY OWNERs and/or Vacay Hill Country Vacation Rentals cannot be held liable or responsible for harm to Guests from carelessness, the carelessness of the individual harmed, or the carelessness of others. The property owner cannot be held liable or responsible for any harm or damage caused by acts of nature or God. Each person on the PROPERTY accepts full liability and responsibility for their own actions and their own possessions. By accepting this reservation it is agreed that GUESTS are expressly assuming the risk and personal responsibility of any harm arising from their use of the PROPERTY.
GUEST also hereby certifies that they have adequate insurance to cover an injury or damage that may be caused or suffered while on the PROPERTY or in the area, or else agrees to bear the costs of such damage or injury. Each person who arrives on the property has read and understands the risks, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

TERMINATION OF OCCUPANCY: Upon termination of occupancy, Guest shall: (i) return all copies of all keys or opening devices to the Premises, including any common areas; (ii) vacate the Premises and surrender it to Management empty of all persons at agreed upon time; (iii) vacate any/all parking and/or storage space; and (iv) deliver the Premises to Management in the same condition less ordinary wear and tear as received upon arrival.

PERSONAL PROPERTY AND INJURY: (i) Owner Insurance: Guest personal property, including vehicles, are not insured by Owner or, if applicable, HOA, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner/Management does not insure against personal injury to Guest, guests or licensees due to any reason other than the condition of the Premises. (ii) Guest Insurance: Management recommends that Guest carry or obtain insurance to protect Guest and licensees and their personal property from any loss or damage. (iii) Indemnity and Hold Harmless: Guest agrees to indemnify, defend and hold harmless Owner and Management from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to Guest or licensees or their personal property.

SERVICE FEE: This helps us run our platform and 24/7 support.

MEDIATION: Guest agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one Guest, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Guest.

ENTIRE CONTRACT: Time is of the essence. All prior agreements between Owner, Vacay Hill Country and Guest are incorporated in this Agreement, which constitutes the entire contract. It is intended as a final expression of the parties` agreement, and may not be contradicted by evidence of any prior agreement or contemporaneous oral agreement. The parties further intend that this Agreement constitutes the complete and exclusive statement of its terms, and that no extrinsic evidence whatsoever may be introduced in any judicial or other proceeding, if any, involving this Agreement. Any provision of this Agreement that is held to be invalid shall not affect the validity or enforceability of any other provision in this Agreement. The waiver of any breach shall not be construed as a continuing waiver of the same or any subsequent breach. 

RELEASE: In consideration of the right to visit the home, Guest agrees to release to the fullest extent allowed by law, Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the Affiliates) from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my childrens or the guests participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me.
